Purpose This Acceptable Use Policy (AUP) governs your use of BookWell and its AI-powered financial workforce platform, including the "Context Graph" and our suite of AI Agents. This policy is incorporated into and forms part of our Terms of Service.

1. Prohibited Content & Activities

Harmful & Illegal Content

You may not use our AI Services to generate, process, or distribute:

  • Content promoting violence, terrorism, or harm to individuals or groups.

  • Harassment, bullying, or threatening content.

  • Content that violates local, state, federal, or international laws (including Australian financial regulations).

  • Instructions for illegal activities, tax evasion, or money laundering.

  • Content that facilitates fraud, scams, or the creation of fraudulent financial records.

Deceptive Practices & Privacy Violations

You may not use the Services to:

  • Generate misleading financial information presented as audited or verified factual data without proper disclosure.

  • Create deepfakes or synthetic media without clear disclosure.

  • Process, upload, or share sensitive Personal Information (including Tax File Numbers or Superannuation details) without explicit authorization and consent from the relevant individuals.

  • Attempt to identify individuals from anonymized or de-identified data.

2. AI Service Misuse & Technical Restrictions

System Integrity

You may not:

  • Attempt to reverse engineer our AI models, the Context Graph, or underlying algorithms.

  • Use automated tools, scrapers, or bots to extract training data or financial insights from the platform.

  • Overload our systems (including our Authorized Infrastructure Partners like Basiq and Payroo) with excessive or malicious API requests.

  • Execute prompt injection attacks or attempt to bypass compliance filters (e.g., overriding the AI Guardian's risk alerts).

Commercial Restrictions

You may not:

  • Resell access to our AI Service without authorization or a formal wholesale partnership.

  • Use our Service, outputs, or Context Graph data to train competing AI models or accounting software.

3. Professional and Regulated Uses (The "Human-in-the-Loop" Rule) Professional Advice Restrictions While BookWell provides advanced probabilistic insights via the AI Analyst, AI Tax Advisor, and AI Wealth Manager, our Services are technological tools, not certified human professionals. You may not use our Service to:

  • Generate and issue definitive tax, legal, or financial product advice to third parties without independent human review and verification by a qualified CPA, Tax Agent, or licensed financial advisor.

  • Represent the outputs of the AI Workforce as legally binding opinions or certified audits.

High-Stakes Decisions & Payroll Processing You may not use our Service for automated decisions affecting critical employment, credit, or housing outcomes without human oversight. Specifically, while the AI Payroller automates wages and Single Touch Payroll (STP), you as the employer must review and approve all pay runs. You cannot use the AI to unilaterally terminate employees or alter employment contracts without human intervention.

4. Communications & Spam Compliance When utilizing the AI Practice Manager to manage client communications or automate emails, you must:

  • Ensure all communications comply strictly with the Spam Act 2003 (Cth), including providing clear unsubscribe mechanisms.

  • Not use the AI to send unsolicited marketing materials (spam) or deceptive phishing emails.

  • Take full responsibility for the tone, accuracy, and legality of any messages drafted and sent on your behalf.

5. Enforcement and Reporting

Monitoring

We may monitor Service usage (in accordance with our Privacy Policy) to:

  • Ensure compliance with this AUP.

  • Protect our systems, our Authorized Infrastructure Partners, and other users.

  • Comply with legal obligations from Australian regulators (e.g., ATO, ASIC, ACCC).

Violations

Policy violations may result in:

  • Warning and education about proper usage.

  • Temporary suspension of Service or specific AI Agent access.

  • Permanent account termination.

  • Reporting to relevant authorities when required by law.

Updates to This Policy
